Scholar transport chaos a legacy of decades of ANC failure Statement by Bulelani Bobotyane, Provincial Secretary of the UDM in the Eastern Cape Years of poor planning and neglect have turned the Eastern Cape’s scholar transport programme into a crisis that now threatens thousands of learners. The decision by the South African National Taxi Council (SANTACO) to suspend scholar transport from 13 October is the direct consequence of the Eastern Cape government’s continued failure to manage and fund this vital programme. This is not an isolated incident but the cumulative outcome of years of mismanagement under African National Congress (ANC) administrations that have consistently failed to prioritise education in this province. For more than a decade, provincial administration has ignored every warning about late payments, corruption, and systemic underfunding. The situation has now reached breaking point. Between 2022 and 2025 alone, the same problems have repeated year after year: • Operators go unpaid for months, leaving them bankrupt while learners are stranded. • In 2024 alone, 50 000 qualifying pupils were excluded from the programme because of budget shortfalls. • The Makhanda High Court ruled in December 2024 that the Departments of Education and Transport acted unconstitutionally by failing to provide scholar transport to all qualifying learners. • The 2025/2026 provincial budget of R800 million has already collapsed under pressure, with funds exhausted by October and scholar transport once again paralysed. • Investigations have revealed millions wasted on “ghost scholar” contracts while real children are left to walk dangerous distances to school. The right to basic education is immediately realisable under the Constitution. The Eastern Cape provincial government has a direct legal duty to provide safe and reliable transport to learners and cannot hide behind excuses of limited funds or administrative delay. Its repeated failure to comply with court orders and to budget adequately for scholar transport places it in clear violation of the Constitution and in potential contempt of the Makhanda High Court judgment. This ongoing neglect is a betrayal of the province’s learners and a breach of the public trust. The UDM in the Eastern Cape demands decisive provincial implementation to restore this critical programme: 1. The Premier must establish a dedicated Provincial Task Team to oversee full implementation of the Makhanda High Court judgment. 2. The MEC for Finance, Economic Development, Environmental Affairs and Tourism, the MEC for Transport and Community Safety, and the MEC for Education must table an emergency adjustment budget to close funding shortfalls and ensure that all payments are made within 30 days. 3. The Department of Transport must publish a transparent list of all verified operators, payment schedules, and outstanding invoices, and must immediately investigate and eliminate the so-called “ghost scholar” contracts that have drained millions from the programme. 4. The Provincial Treasury must ring-fence all scholar transport funds and prevent diversion to other programmes. 5. The Provincial Legislature’s Education and Transport Committees must conduct monthly oversight visits to monitor compliance, investigate allegations of fraud and mismanagement, and report publicly on progress. There can be no excuse for the Eastern Cape provincial government that once again fails its most vulnerable citizens. The children of the Eastern Cape deserve leadership that plans, pays, and delivers. The UDM in the Eastern Cape will continue to hold the provincial administration accountable until every qualifying learner has safe and reliable transport to school, not as a favour but as a right. This crisis is the direct legacy of the ANC’s decades of neglect and poor governance, which have left the province trapped in a cycle of underfunding, corruption, and administrative failure. As a partner in the Government of National Unity (GNU), the UDM in the Eastern Cape calls on Minister of Basic Education, Ms Gwarube, to intervene decisively. The Minister must ensure that the Eastern Cape government complies with the Makhanda High Court judgment and delivers on its obligations to learners and communities. The GNU cannot allow provincial failures to undermine national commitments to education. Minister Gwarube must demand accountability, enforce compliance with court orders, and ensure that public funds allocated for scholar transport are used transparently and efficiently to restore faith in government and uphold the constitutional right to education.
Dear President Ramaphosa DEPARTMENT OF HIGHER EDUCATION AND TRAINING: FURTHER ALLEGATIONS OF MINISTER NZIMANDE’S POLITICAL INTERFERENCE: APPOINTMENT OF PARTY CRONIES 1. I refer to my letters of 24 and 31 August 2020 regarding allegations of interference of the political head of the Department of Higher Education and Training (DHET), the Minister of Higher Education, Science and Technology, Dr Blade Nzimande, in departmental processes and administration, as well as the undermining of the senior departmental accounting officers. 2. Minister Nzimande’s alleged direct interference in procurement processes, such as what apparently happened with the National Student Financial Aid Scheme (NSFAS) laptop tender, clearly has disastrous consequences. This much vaunted project has flopped; everyone sits with egg on their faces and our students are left right where they started, without learning devices. NSFAS’s feeble attempt to mitigate the damage, effectively blaming a total of 150 bidders for “getting it wrong”, is almost laughable. 3. It has now come to my attention that Minister Nzimande was allegedly directly involved in twelve DHET appointments in the 2019/20 financial year that were not made in line with Public Service Regulations (PSR) and/or the Public Finance Management Act (PFMA) 1 of 1999. 4. The salaries of these twelve allegedly irregularly appointed individuals cost the taxpayer around R9,7 million a year, but once you consider the allegation that the majority of them are South African Communist Party comrades of the Minister, their appointments take another flavour and one can see why the regulations were seemingly so grossly flouted. 5. It is alleged that, in March 2020, five employees additional to the DHET establishment were appointed, but that there were no logic or justification for the creation of these posts in terms of Section 57(2) of the PSR. Apparently, the posts were not even advertised. I also understand that there was no appointment committee and no competency assessments were conducted as required by Section 67(1). Lastly, there were allegedly no vetting or checking of qualifications in terms of Section 57(3). These appointments are: 6. Another alleged appointment where the Minister had a hand in, is that of a 12-month contract of a Deputy Director-General Planning, Policy and Training, whilst this post already existed in the department establishment and it was vacant. The story with this appointment is the same as with the previous five; none of the PSR prescriptions were adhered to. 7. Two staff members were allegedly headhunted, whilst this is only allowed in terms of the DHET Recruitment and Selection Policy under certain circumstances as described in Section 2.1.6. For some reasons, apparently known only to the Minister, they were both headhunted after only one failed advertisement and the process was not conducted by a recruitment agency. Also, apparently, no verification of their qualifications has been done; they are: 8. The last four instances where the Minister apparently had a hand in are listed below, and as I understand it, there is no evidence on file, that indicates that their qualifications/studies and employment verifications were performed prior to their appointment as is required by Section 67(9a) of the PSR. 9. Much as the blustering rationalisations and irritable explanations come from the Minister, no amount of spin-doctoring can camouflage the dysfunction within the DHET, the Sector Education and Training Authorities (SETAs) and NSFAS. 10. Given the information that you have, I am interested to know what actions you have taken, or plan to take, to address these serious allegations against Minister Nzimande? Have you, at all, considered the United Democratic Movement’s call to suspend him? If not, why not? 11. Lastly, in the interest of setting the record straight, I also refer you to Minister Nzimande’s use of a ministerial briefing to strike at me and his use of a manipulative lie when he said I have an interest in doing business with his department. I wonder how he justifies conscientiously executing his oath of office if a lie is so easily told using a government platform. I wish to place on record that I am not the businessman he disparaged me to be, and that I have no interests, nor have I ever had, in any companies that do business with government and/or any of its entities. I have, in an effort to clear this up with the Honourable Minister, gone to the extent of offering to engage him on this topic on any live radio or television platform of his choice, but the response from his corner has, thus far, been mute. The shocking video clip that has been circulating on social media, of a female learner degradingly, physically abusing another, who tried to shield herself from the beating, has left us repulsed. This incident, taking place between two Mathole High School learners, is yet another harrowing demonstration, this year alone, of the undesirable culture of bullying in our schools and in our broader society. The United Democratic Movement Youth Vanguard (UDM Youth Vanguard) commends the KwaZulu-Natal Education Department’s suspension of two Mathole High School learners in relation to the incident, although we would like to understand why the second learner was suspended. We are also happy to hear that the victim, in particular, will receive counselling, that she has been advised of her rights and that she will be assisted in opening a case with the police. Bullying is an increasingly prevalent problem in schools and the degree of violence is arguably escalating. Not only does bullying directly affect academic performance, but it also has long-term damaging effects on a child’s confidence and self-esteem. Consequently, bullying extends far beyond the academic scope as learners can also develop anger issues and are far too often driven to suicide. It is for this reason that we call on the Department of Basic Education to take a long-term view in addressing all types of bullying in schools. An inclusive solution should include the implementation of a standardised anti-bullying policy for all schools and increased awareness campaigns, to teach learners, teachers and school governing bodies about bullying and its serious consequences. The UDM Youth Vanguard denounces physical, emotional, verbal, cyber, sexual and prejudicial bullying and we stand with those who say that this undesirable culture has no place in our institutions of learning. Schools, universities, colleges and other places of learning should not be palaces of terror, but temples of learning where our youth are safe to fulfil one mission and that is to learn. After numerous calls and press statements from various organisations, including the United Democratic Movement (UDEMWO), as well as frustrations from parents, sundry teachers’ unions and those who care for the younger generation and the nation at large, the President of South Africa finally took the brave and courageous decision to close schools for some time. UDEMWO welcomes President Ramaphosa’s intervention to close schools for four weeks, Looking from a climatological view, as the country, we will be seeing the back-side of the winter season so the young pupils being Grade R will go back to classroom when it is a little warmer. The Department of Basic Education should use this time to clean up schools, procure the required personal protective equipment (PPE) and monitor the infections, death and recoveries, no blanket opening of schools, our children are not weapons to fight coronavirus, they must be protected at all cost. UDEMWO also accepts the extension of the current academic year into 2021, should the community transmission of Covid-19 continue to increase, the nation must be prepared to sacrifice this school year. Schools opened yesterday and the United Democratic Movement Women’s Organisation (UDEMWO) is outraged at government’s willingness to risk the lives of school pupils and teachers. It was quickly reported that Gauteng alone had 38 schools with coronavirus infections and the Western Cape had 55; which is the epicentre of this deadly enemy at the moment. Three weeks ago, UDEMWO warned the Department of Education not to open schools until it is safe. We have pleaded with Basic Education Minister Angie Motshekga to act as a parent, yet she chose not to. UDEMWO is aware of a learner at Woodhill College (Pretoria) who tested positive for Covid-19, thus endangering all the came into contact with that learner. We are also in possession of a letter from West Bank High School (East London), where a learner whose parent tested positive and the school was forced to send back home all grade 7 learners until further notice. UDEMWO calls on the Department of Basic Education and the National Coronavirus Command Council to urgently review this decision, even if it means that the current academic year must be revised. South Africa cannot afford this kind of negligence, young lives are at stake and not all immune systems can fight this disease; think of pupils in rural areas where there is no clean water and poor toilet facilities.
