Statement by Zandile Phiri, Acting Secretary General of the United Democratic Movement
The United Democratic Movement (UDM) fully supports the Pretoria High Court’s decision to dismiss the application brought by the Society for the Protection of our Constitution.
The application sought to compel government departments, including the police, to provide emergency disaster relief to illegal miners trapped underground in Stilfontein.
The judgment delivered by Judge B Neukircher rightly affirmed that the necessary rescue efforts are already underway and that the allegations against the government were unfounded.
The court acknowledged that the Society for the Protection of our Constitution lacked the expertise and evidence to propose alternative rescue methods, and it commended the existing efforts of government departments.
The reality as the SAPS has indicated, is that many of the illegal miners have chosen to remain underground to avoid arrest.
This is unacceptable and highlights the broader issue of illegal mining in South Africa which threatens lives, communities and our economy.
The UDM calls on the government to intensify efforts to combat illegal mining and hold those responsible accountable.
While we support the humane treatment of individuals involved, we must address the root causes of this dangerous activity including poverty, unemployment and criminal syndicates.
The Pretoria High Court’s decision reinforces the importance of balancing constitutional rights with public safety and the rule of law. The UDM remains committed to advocating for solutions that protect both the people of South Africa and the integrity of our natural resources.
The UDM applauds the SAPS and other government departments involved in Operation Vala Umgodi for their commitment to upholding the rule of law while ensuring the safety and dignity of all individuals.
The SAPS has demonstrated transparency and care by allowing limited food and water to reach the miners, keeping medical emergency teams on standby and confirming that alternative exit routes remain accessible to those underground.
